JSD Cinema: Terms and Conditions

At JSD Cinema, we understand that capturing your special moments is a significant part of preserving your memories. Whether it’s your wedding day, a music video, documentary, pre-wedding shoot, post-wedding celebration, or any other occasion, our team is dedicated to telling your story through high-quality photography and videography. Our services are subject to the following Terms and Conditions, which are tailored according to the specific requirements of each assignment. The details below serve as a general guide and may vary as necessary.

1. Use of Images & Videos

  • All images and videos produced by JSD Cinema are intended for the client’s private, personal use unless otherwise specified in the contract.
  • JSD Cinema grants the Client exclusive rights to use the images and videos for personal display and any specific publication agreed upon at the start of the project.
  • If the Client publishes any images or videos (e.g., on the web, social media, or other media), a credit to “Images by JSD Cinema” is required.
  • Clients may use images for personal promotions or announcements with our prior consent.
  • JSD Cinema reserves the right to use images and footage from the shoot for promotional purposes, including our website, social media, or other marketing channels.

2. Payment Terms

  • A non-refundable deposit of 10% is due at the time of booking.
  • An additional 80% of the total fee is due on the first day of the event, with the remaining 10% due before final album printing or video delivery, following the client’s review of demo work.
  • Acceptable payment methods include cash, personal cheques, and bank transfers.

3. Reshoot Policy

  • The Client should designate an authorized representative to be present at the shoot to provide guidance if needed.
  • If a reshoot is requested by the Client, an additional fee equal to the original project cost will apply, plus any associated reshoot expenses.
  • In cases where a reshoot is necessary due to circumstances beyond our control (e.g., weather, acts of God, third-party interference), JSD Cinema will not charge an additional fee, though the Client will cover related expenses.

4. Delivery Timelines

  • Weddings, Documentaries, Music Videos, and Other Projects: Raw footage and photos are generally delivered within 1 week to 1 month through email or device transfer.
  • Photo Selection: Clients have 1-2 months from the event or shoot date to finalize photo selections.
  • Final Delivery: Edited videos, promos, and photo edits are delivered within 45 days; selected photo edits will be ready within 15 days after selection.
  • Clients are permitted one round of revisions for video and photo edits.

5. Termination of Contract

  • If the Client chooses to terminate this Agreement, any fees paid up to that date will be non-refundable.
  • Termination must be submitted in writing and sent via registered mail or email to JSD Cinema.

6. Liability

  • JSD Cinema and its associates are not liable for unforeseen issues, including but not limited to accidents, equipment malfunctions, or restrictions at the event location.
  • We are not responsible for limitations or restrictions imposed by the venue or environment (e.g., lighting, interference, access restrictions).
  • If JSD Cinema fails to perform its duties for reasons within our control, our liability is limited to a refund of all payments made by the Client.

7. Warranty and Indemnity

  • JSD Cinema guarantees that it holds all copyrights and ownership of the images and videos produced and that these do not infringe upon the rights of any third parties.
  • The Client agrees to indemnify and hold JSD Cinema harmless against any claims arising from breaches of this warranty.

8. Permissions to Photograph and Film

  • The Client is responsible for securing necessary permissions for JSD Cinema to conduct photography and videography at the chosen venue(s).
  • The Client should arrange the setup and placement of key participants to allow for unobstructed views during significant moments of the event.

9. Final Product

  • JSD Cinema is hired for its technical and artistic expertise. Therefore, final editing and stylistic decisions rest with our team, based on the agreed-upon aesthetic for the project.
  • We do not guarantee that all individuals present will be included in the final output.

10. Photographer/Videographer Substitution

  • In the event that the assigned photographer or videographer is unavailable due to illness or unforeseen circumstances, JSD Cinema will provide a suitable substitute professional at no additional cost.

11. Exclusive Photographer and Videographer

  • JSD Cinema will be the exclusive photography and videography provider for the contracted event or project.
  • Friends and family may take photos or videos, provided they do not interfere with JSD Cinema’s work.

12. Coordinator Responsibilities

  • Due to the dynamic nature of events, it is the responsibility of the event coordinator, client, or planner to inform our team of key moments (e.g., ceremony start, performance highlights, cake cutting, toss of bouquet).
  • A designated person should also assist with organizing group photos and ensuring that all intended groups are accounted for.

These Terms and Conditions are intended to clarify and protect both the Client and JSD Cinema. Please note that specific terms may be adapted based on the unique needs of each project. We look forward to capturing your most meaningful moments with professionalism and artistry.
